The Banned List is not restricted to audio products only, as the new scheme will be looking to provide clearance for many different products. The Banned List operates on a product basis, rather than individual sound recordings, therefore a sound recording owner may “ban” for example a particular toy which contains their copyright sound recording.
What happens if a customer is granted permission to import a product on the Banned List by the sound recording owner?
- You have the option of going directly to the sound recording owner for permission to import a product which may be on the Banned List.
- Where such permission is granted the product will be removed from the Banned List, unless there are exceptional circumstances which the sound recording owner must make us aware of in writing in order to retain the product listing on the Banned List. In other words if the importation clearance is specific to an exclusive arrangement with one customer and therefore the product must remain on the Banned List for the purposes of restricting other customers.
How do you find out what is on the Banned List?
- The Banned List is published on this website, and updated whenever a new banned product is submitted.
- We will also send an email to all customers on the last day of the month that contains a URL to the webpage where the full list can be viewed.
Customer obligations
- The onus will be on the customers to view this page to make sure they do not import any banned product. However monitoring activities have been put in place by us, BPI and AIM to manage this process.
