AP.1 Agreement

The AP1 Agreement allows the issuing of audio products (CDs/LPs) for retail sale. Under the scheme, you are charged for your net shipments during a quarterly period.

What are the rights and formats covered under the scheme?

To be able to manufacture and distribute CD and other audio formats, including SACD and DVD-Audio (where there are no moving visuals).

 

How do you apply for the scheme?

Inclusion on the scheme involves an application process, where you will have to demonstrate creditworthiness and administrative capability. Details on how to apply can be found in the AP1 Criteria.

 

Once admitted onto the scheme, do you have to apply for individual product clearances?

Yes

 

How do you obtain product clearance under the agreement?

To obtain clearance you must complete a Notification of Intended Release Form for every type of audio product you intend to manufacture and ship. We should receive this at least 7 days before the intended release of the product.

You can apply for a product clearance via Catco if you are a PPL member. Catco will then forward your details to us. If you are not able to use the Catco system, we need to receive the product details either via our standard format, which you can download, or sending the information from your own database, providing that all the required information is included.

If the details of your product change please submit a Product Amendment form to us or, if using Catco, submit an amendment notification to Catco.

 

How much do you pay?

With Published Dealer Price - 8.5% of PDP x net number of copies shipped (plus VAT)

If this is unavailable - 6.5% of Retail Price x net number of copies shipped (plus VAT)

The charge is reduced proportionately if any of the music on the CD/LP is in the public domain or is non-MCPS repertoire. Where timings are not available, tracks will be treated as of equal duration.

What countries does the scheme cover?

UK based companies for all of Europe.

 

Can you give copies away for promotional purposes to trade contacts?

Yes. Promotional copies cover all formats and are limited as follows:

Albums - 1,500 copies

Singles - 3,000 copies

The number of promotional copies must be detailed within your Statement of Shipments (SOS).

Promotional copies are not subject to a MCPS royalty provided that certain guidelines are followed:

  • 'PROMOTIONAL COPY - NOT FOR SALE' should be displayed on the CD sleeve/packaging as either a non-removable sticker or a non-erasable notice.
  • Promotional copies should be supplied free of charge to a broadcaster, DJ, critic or other relevant party for promotional use only (i.e. to review or broadcast).

Alternatively there is an unlimited promotional copy option. In order to qualify for this, the artwork of the CD/LP should be marked as promotional only and a detailed list of all recipients kept. Prior arrangement with MCPS must be made.

What does the scheme exclude?

The onward rental of the audio-only product (public libraries have special arrangements). Record clubs. Recordings of shows or excerpts from shows (we will direct requests to you). Deletions and exports are subject to special provisions.
