AP.2 Agreement

The AP2 Agreement allows the issuing of audio products (CDs/LPs) in the UK for retail sale. Under the scheme you are charged based on the quantity of products to be manufactured in advance of the actual manufacture.

If you are an amateur music user and you are not distributing your product via a third party then you may be eligible for our Limited Manufacture Licence.

How to obtain clearance for the issuing of CDs/LPs for retail sale to the public.

What are the rights and formats covered under the scheme?

To be able to manufacture and distribute CD and other audio formats, including SACD and DVD-Audio (where there are no moving visuals).

 

How do you apply for the scheme?

You must make an application via AFL-Online

 

Once admitted onto the scheme, do you have to apply for individual product clearances?

Yes.

 

How do you obtain clearance under the scheme?

A separate application must be completed for every type of audio product you intend to manufacture and ship.

Applications for the first pressing or manufacture can be submitted to us via the AFL-Online or via CatCo if you are a PPL member. Catco will then forward your details to us. For any further manufactures you must complete a Re-press form and return it to us.

Please note that clearance for additional manufactures of your product can only be submitted to us via paper form. These are supplied with your initial clearance.

 

How much do you pay?

With Published Dealer Price - 8.5% of PDP x number of copies to be manufactured (plus VAT)

If this is unavailable - 6.5% of Retail Price (excl VAT) x number of copies to be manufactured (plus VAT)

The charge is reduced proportionately if any of the music on the CD/LP is in the public domain or is non-MCPS repertoire. Where timings are not available, tracks will be treated as of equal duration.

 

How does the clearance process work?

Application Form submitted to MCPS ---> MCPS raise an invoice ---> Payment Received ---> Clearance granted to record producer and pressing plant ---> Manufacture takes place.

 

What does the scheme exclude?

The onward rental of the audio-only product (public libraries have special arrangements). Record clubs (dealt with under the AP6 scheme). Recordings of shows or excerpts from shows (we will direct requests to you). Deletions and exports are subject to special provisions.

 

What are the main restrictions of the scheme?

Where you are applying for a first pressing of 500 copies or more, up to 25% may be cleared as promotional copies, with a limit of 400 per format for a single and 250 per format for an album. This option must be identified on the application form. If fewer copies are required, this should be identified on the form.

Promotional copies are not subject to a MCPS royalty provided that certain guidelines are followed:

  • 'PROMOTIONAL ONLY - NOT FOR SALE' should be displayed on the CD sleeve/packaging as either a non-removable sticker or a non-erasable notice.
  • Promotional copies should be supplied free of charge to a broadcaster, DJ, critic or other relevant party for promotional use only (i.e. to review or broadcast).

Alternatively there is an unlimited promotional copy option. In order to qualify for this, the artwork of the CD/LP should marked as promotional only and a detailed list of all recipients kept. Prior arrangement with MCPS must be made.
