The KAR Agreement covers the use of music and graphic lyrics in karaoke products made in the UK for sale to the public.

How to obtain clearance to use music and graphic lyrics in karaoke products.

What are the rights and formats under the scheme?

The rights covered are mechanical (making copies of the music) and synchronisation (using music with audio-visuals) across CD+G, NEO+G, DVD, DivX, VHS and Karaoke Chip formats (other formats may be agreed by us).

 

How do you apply for the scheme?

To apply you must complete a KAR application form. The application must be signed and returned to us.

Once admitted onto the scheme, do you have to apply for individual product clearances?

Yes.

 

How do you obtain product clearance under the scheme?

You must provide details of all intended releases using a notification of intended release form at least 28 days prior to the release date of each product.

Products are subject to prior approval where;

  • the product title, packaging or advertising names or depicts featured artists or groups and/or featured composer(s)/writer(s)
  • the product includes content depicting an artist(s) associated with the tracks (unless clearance from their management has been obtained)
  • the product features more than 5 tracks either by the same artist/band or written by one composer or writer, or song writing partnership

 

How much do you pay?

12% of the Published Dealer Price x number of copies shipped

The charge is subject to a minimum dealer price of £3.00 per disc.

Where this is unavailable the charge is calculated as 10% of the Published Retail Price (excl. VAT) subject to a minimum of £3.60 per disc.

 

How does the reporting and payment process work?

MCPS notified of shipments ---> MCPS issue invoice ---> Clearance granted upon receipt of payment.

You must inform us of all shipments made (minus returns) within 30 days following the end of each relevant calendar quarter using a Statement of Shipments form.

 

Can you give copies away for promotional purposes?

No. These are cleared under a separate agreement. Contact us for more information.

 

What does the scheme exclude?

Games (where the game is the main feature).  Advertisements and sponsorship messages. Implication of approval or endorsement by the composer, writer or artist associated with the music. Controversial visuals unless directly related to the lyrics of the music. Recordings of shows or excerpts from shows. Hardware samplers (download Hardware Sampler application).

 

What are the main restrictions of the scheme?

A maximum track provision of 30 tracks per disc.
